பொதுநல வழக்குகள் தொடர்வதன் மூலம் அரசுக்கும், வணிக நிறுவனங்களுக்கும் பெரும் சவாலாக இருந்து வருபவர் டிராபிக் ராமசாமி.
திமுக, அதிமுக ஆகிய இரு கட்சிகளும் சரமாரியாக அறிவித்துள்ள இலவச திட்டங்களைத் தடை செய்யக் கோரி சமூக நல சேவகர் டிராபிக் ராமசாமி சென்னை உயர்நீதிமன்றத்தில் வழக்கு தொடர்ந்துள்ளார்.
திமுகவும், அதிமுகவும் தேர்தல் அறிக்கைகளை வெளியிட்டுள்ளன. அதில் இலவசமாக மிக்சி தருகிறோம், கிரைண்டர் தருகிறோம், ஆடு மாடு தருகிறோம், தண்ணீர் தருகிறோம், இலவச பஸ் பாஸ் தருகிறோம் என்று சரமாரியாக இலவச திட்டங்களை அறிவித்துள்ளனர்.
தமிழகத்தின் இந்த அரசியல் இலவச அறிவிப்புகள் நாடு முழுவதும் பரபரப்பு அலையை ஏற்படுத்தியுள்ளது. தமிழ்நாட்டை இலவச நாடு என்று வட இந்திய மீடியாக்கள் கிண்டலடிக்கும் நிலையும் ஏற்பட்டுள்ளது.
இந்த நிலையில் சமூக நல சேவகர் டிராபிக் ராமசாமி சென்னை உயர்நீதிமன்றத்தில் ஒரு பொது நலன் மனுவைத் தாக்கல் செய்துள்ளார்.
அதில், வாக்காளர்களுக்கு லஞ்சம் தருவது போல அமைந்துள்ளது சில கட்சிகள் அறிவித்துள்ள இலவச அறிவிப்புத் திட்டங்கள். இந்த இலவச அறிவிப்புகளை தேர்தல் ஆணையம் தடை செய்ய உத்தரவிட வேண்டும். |
பஸ் கட்டண உயர்வை எதிர்த்து வழக்கு |
சென்னை, நவம்பர் 21: தமிழக அரசு அறிவித்துள்ள பஸ் கட்டண உயர்வை ரத்து செய்யக் கோரி சென்னை உயர் நீதிமன்றத்தில் வழக்கு தொடரப்பட்டுள்ளது.
இது தொடர்பாக சமூக ஆர்வலர் டிராஃபிக் ராமசாமி சென்னை உயர்நீதிமன்றத்தில் தாக்கல் செய்த பொது நல மனுவில், "தமிழ்நாட்டில் பஸ் கட்டணம் உயர்த்தப்படுவதாக இம்மாதம் 17-ம் தேதி தமிழக அரசு அறிவித்தது. இதனால் 30 முதல் 50 சதவீதம் வரை கட்டணம் உயர்த்தப்பட்டுள்ளது.
எனினும், இந்தக் கட்டண உயர்வு குறித்து முன்னதாகவே மக்களுக்கு தெரியப்படுத்தப்படவில்லை. மோட்டார் வாகனச் சட்ட விதிகள் படி, பஸ் கட்டண உயர்வு குறித்து பொதுமக்களுக்கு பத்திரிகைகள் மூலம் அறிவித்து, உரிய கால அவகாசத்துக்குப் பின்னரே, அந்த அறிவிப்பை அமல்படுத்த வேண்டும்.
ஏற்கெனவே, கடந்த 2001-ம் ஆண்டு இதேபோல் பொதுமக்களுக்கு முன்னரே அறிவிக்காமல் பஸ் கட்டணம் உயர்த்தப்பட்டது. இதனை எதிர்த்து தொடரப்பட்ட வழக்கில் நீதிமன்ற தலையீடு காரணமாக அப்போது பஸ் கட்டணம் குறைக்கப்பட்டது.
இந்த சூழ்நிலையில், இப்போது பொதுமக்களுக்கு முன்னரே தெரியப்படுத்தாமல் தமிழக அரசு திடீரென பஸ் கட்டணத்தை உயர்த்தியுள்ளது. இதனால் பொதுமக்கள் பல பாதிப்புகளை அடைந்துள்ளனர்.
எனவே, தமிழக அரசு பஸ் கட்டணத்தை உயர்த்தியதற்கு நீதிமன்றம் தடை விதிக்க வேண்டும்" என்று கூறப்பட்டுள்ளது.
இந்த மனு மீது உடனடியாக விசாரணை நடத்த வேண்டும் என்று நீதிபதிகள் எலிபி தர்மாராவ், ஆர்.சுப்பையா ஆகியோரைக் கொண்ட அமர்வு முன் டிராஃபிக் ராமசாமி திங்கள்கிழமை முறையிட்டார். அப்போது, இந்த மனு மீது செவ்வாய்க்கிழமை விசாரணை நடத்துவதாக நீதிபதிகள் தெரிவித்தனர். |

Traffic Ramaswamy is a 75-year-old former mill worker, a founder member of Tamil Nadu's Home Guard, and a self-appointed traffic policeman, public interest litigator and social activist from Chennai.
Much of his activism relates to regulating traffic in Chennai. Initially, he started unofficially directing traffic at the city's busy Parrys Corner. The local police were pleased with his efforts and provided him with an official identity card. He acquired the nickname, Traffic Ramaswamy after that. |
He has brought many public interest law suits in the Madras High Court. In 2007, he was attacked by his opponents' lawyers on the steps of the courthouse. This was not the first time, he has been attacked: in 2002, he was assaulted by fish sellers, after he obtained a ban on the use of motorised fish carts, damaging his sight and his family have disowned him. He has also had his office ransacked and papers were stolen. However, helped by donations from friends, he claims he will continue his fight to make Chennai the most livable and lovable city.
His activism has resulted in the demolition of some illegally constructed buildings in Chennai, restrictions on motorised fish carts, de-congestion of major bus routes by banning auto rickshaws from them, and a review of lavish state funding for a feature film (arguing the money could be more properly used for development work). He is now accompanied day and night by an armed police bodyguard.

29 Dec. 2009: Hawkers and street vendors on the service lanes on Usman Road in T. Nagar ran for cover on Tuesday morning after they got news of a raid to remove encroachments on service lanes.
Interestingly though, it was not the police or corporation officials who chased them away but septuagenarian activist ‘Traffic’ Ramaswamy and about two dozen of his associates who were on anti-encroachment campaign along the roads. The group rallied from T. Nagar police station along Usman Road and returned to the same spot after removing encroachments for a couple of hours.
Speaking to this newspaper, ‘Traffic’ Ramaswamy said, “Service lanes are already congested but they continue to remain exploited the most, especially in T. Nagar,” adding “We will continue this rally once or twice a week to free service roads of all encroachments.”
Locals, who witnessed even bigger shop owners clear all their encroachments on seeing the senior citizen, were surprised. “Shopkeepers here do not even budge when they see police officials, it is heartening to see them react finally to an activist,” said Jonathan (name changed), a local resident who witnessed the drive. |

His PIL to ban the fish-cart vehicle (tri-wheeler motorized rickshaws) in September 2002 earned the wrath of the fish-cart drivers and he was attacked right in front of the L & O Inspector. Ramaswamy’s PIL was to find a way to end the fish-cart connected accident that was growing in the city and many two-wheeler riders became victims. When the attack was reported to the Court, he was provided with armed police guard. Since 2002 he is with an escort police. |
If T.Nagar’s Usman Road and Ranganthan street, which were bursting in seams with shopping crowds, it is because Traffic’s PILs that pulled down high raise buildings (Chennai silks, Saravana Stores, Jayachandra Textiles to name a few), removed the hawkers, regulated unauthorized constructions.
In 2007, Ramaswamy’s PIL made Motor Vehicles Act section 129 enforceable with wearing helmet made compulsory throughout the country. He brought out the dormant rule to the light that motor vehicle sellers’ package should include an helmet also. This gave way to a Government Order (G.O.) that directed RTO to register a vehicle with an helmet, like insurance papers, road tax, pollution check certificates, although ‘helmet-rule’ is followed in breach today, due to political ‘go slow, go soft’ direction.
If the city’s water bodies like Porur lake is glistening with sheet of water, again it is because of his PIL, the encroached huts and colonies were cleared, and Cooun river in front of MGR university at Maduravoyal is back to its full breadth. |
20 Oct 2010: Ramaswamy, a 77-year-old former mill worker, had filed a writ petition last year to shift the cracker shops in the city's busy pockets such as Bunder Street, Badrian Street, Anderson Street, Malayaperumal Street, Umpherson Street and NSC Bose Road. That had led the First Bench of the High Court to pass an order on August 24, 2009, directing the commissioners of Chennai corporation and the city police to consider the proposal for shifting the shops to the Isl and grounds or to “some other appropriate open ground” in the city. The civic body and the police force were also asked to frame a scheme and explore the possibility of settling the matter once and for all.On Tuesday, the petitioner contended that both commissioners had, in contradiction to the order, renewed licences for the cracker shops in the same locality.The First Bench comprising Chief Justice M Y Eqbal and Justice T S Sivagnanam ordered issuance of notice returnable by eight weeks. True, the Festival of Lights (falling on November 5) would be over by then. Yet, the move could mean sorting out the issue at least when Chennaiites cele brate Deepa vali next year. |

The protest against the changes in the alignment of the Mass Rapid Transit System (MRTS) phase-II extension linking Velachery to St. Thomas Mount gained pace with affected residents observing a fast on Saturday.
Residents say that they are stepping up the protest since piling work has started three days ago on a contested 1.4-km stretch. They claim that a government order to go ahead with work on this stretch was yet to be issued. In response to an RTI query filed on July 14, the government replied, on September 3, that “the new proposal is under process and may be approved or disapproved.”
The original approved alignment was supposed to go over poromboke land in a flood water canal near St. Thomas Mount.
The 45-metre-wide canal has been reduced to a width of three metres in certain portions due to encroachments and residents claim that the deviation from the original alignment is being pushed through to help the encroachers.
The proposed realignment will result in the demolition of over 70 residences in Thillai Ganga Nagar, Jeevan Nagar and Tiruvalluvar Nagar, all of which are CMDA-approved layouts.
S. Ekambaram, a 76-year-old retired TNEB engineer, said “An unbiased and competent technical panel should review the claims made by Southern Railway and the CMDA (Chennai Metropolitan Development Authority). The vigilance department must enquire into the deviations and malpractices by some junior officials.” |

CHENNAI: The Madras High Court on Monday directed authorities to “consider and do the needful in accordance with law,” if Traffic Ramaswamy, a public interest litigant, makes a representation to them seeking removal of encroachments on various roads in the city.
Passing orders on a petition filed by Mr. Ramaswamy, the First Bench, comprising Chief Justice M. Yusuf Eqbal and Justice T.S. Sivagnanam said, “In the absence of specific allegations against the persons who are in such unauthorised occupation, it is not possible to pass any specific order against those persons.”
The Judges said they could only direct Mr. Ramaswamy to approach the authorities by filing representation giving particulars.
“If such representation is filed, the authorities shall consider the same and do the needful in accordance with law,” they said.
Illegal huts
Mr. Ramaswamy's allegation was that many persons had illegally built huts and permanent buildings over footpaths on Muthusamy Road, N.S.C. Bose Road, Thanjai Murugappa Road, Rattan Bazaar Road and Evening Bazaar Road.
He had personally visited these areas and found that the persons occupying these illegal constructions were tapping electricity from an electric junction box and also from streetlight posts using overhead hanging cables.
“It is posing a great risk to the life of motorists and pedestrians moving along those roads,” he said.
Mr. Ramaswamy also alleged that many illegal activities such as selling of drugs, narcotic substances and organised prostitution were being carried on in these illegal constructions.
No action taken
He said though he made representation to authorities no action was taken so far.
Besides seeking immediate removal of unauthorised constructions, he wanted the Electricity Board to disconnect electricity supply to the illegal constructions. |
